My partner has a 16yr son, who is leaving school to do a work based apprenticeship as a brick layer. As he will receive payment starting at £100 a week and then increasing to £130.00 after 12 weeks basic training, we understand that the maintenance payments for his eldest child stops at the end of August.

However, he is unlikely to secure a grade C in maths and English, so will be tutored to re sit these exams, so does this change the above maintenance rule.

Its all very confusing

If you partner has a family-based arrangement in place, he may wish to try to discuss and negotiate his maintenance payments with the other parent. Family-based arrangements are not legally enforceable and there are no strict rules or formulas to stick to when calculating child maintenance. Therefore, parents can decide the terms of their agreement to suit their current circumstances.

If your partner has a case with the Government’s statutory scheme he may wish to speak to them directly to discuss his concerns regarding his payments. He will find their details on any letters they have sent him or on Gov.uk at www.gov.uk/child-maintenance

If your partner has a Consent Order/Minute of Agreement in place, he may wish to see what is stipulated within the agreement as to when his payments would stop. Alternatively, he may wish to seek legal advice regarding this.

Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. When a child leaves full-time education in the summer, Child Benefit generally continues until the first week of September.
