Not paying maintenance

I have a court order which states child maintenance as a lump sum for both childeren. My son has gone to live with his dad and he is now refusing to pay any maintenance at all. It is my understanding that when the order is a year old he can apply to change it but until then he has to pay. Can anyone tell me how to enforce it without paying too much money please

Not sure how you enforce but know you have to wait until its a month in arrears, you cant claim before then. How long has Consent Order been in place?

You are correct in saying that a Consent Order has to be in place for at least 12 months before any amendments are made. If your son’s dad is not honouring the Consent Order, you would have to return to court to have the order enforced. This would involve you seeking some legal advice, of course. You may be able to find some more help or information on legal advice here, www.justice.gov.uk/legal-aid.

The Department for Work and Pensions (DWP) have a web application, ‘Sorting out separation’. It aims to make it much easier for separating and separated parents (and childless couples) to find the support they need, when and where they need it, and encourages them to collaborate on a range of issues.
