If your son is in 6th form CSA wouldn''t stop on 18th birthday anyway even if he was finishing after exams this year.

End date would be first Monday in September.

Thanks WY - I know they wouldn''t stop - but my ex will cancel his standing order to CSA - it''s going to take several months for them to get him to re-start the payments - that''s my worry.
I also wondered if he''s paying money direct to my son will that affect my CSA payments - I didn''t think he could pay him instead - I thought the money had to come to me!
He''s just looking for excuses not to pay because I know he told my son he''s going to pay him direct but that will stop after a week anyway - he''s not very reliable and obsessed with money!

If he wants to pay money directly to your son then that is up to him, and admirable if he does, but does not make a jot of difference to his CSA liability.

If he cancels the standing order then obviously they will chase him for the payments and arrears. Unfortunately it is a bit out of your hands because they can''t do anything about him defaulting until he does.

But if he does default then he is a fool to do so.

Thanks WY - again! - I guess I will wait until it happens - he''s been a bad erratic payer all through anyway - hence at one point a deduction of earnings!
You say paying my son direct is admirable - if you knew what else was going on - you wouldn''t say that it''s all to look good on paper for the 2-day trial FH approaching! Soon as that is over it''ll stop!
At least I now know it won''t affect my CSA payments whatever silly games he is and continues to play.
Blackmail also comes into it as my son refuses to see him (his choice) - maybe he thinks a few quid will alter that - ??

Hi

Can I just jump on this thread and check something please?

Would the CSA include a child who is 19 years old and at university? He lives away from home. (I assume his mother would no longer receive child benefit for him either)?

Thanks,

EA

Hi EA

No I don''t think so.

Found this on the HM Gov website.

A CSA assessment does not normally show a cessation date as it should be reviewed at regular intervals by the CSA, usually every two years.

Payments will normally end when a child reaches age 16, unless they must continue to age 19 to allow the child to complete full time education (but not advanced education for a degree or similar qualification) or to age 18 if the child is registered for work or youth training but has not yet started youth training or found work which will last for more than 12 weeks after he/she reaches age 16.

If the child receives Income Support in his own right he ceases to be a ''child'' for the purposes of the CSA.

Once a child leaves secondary level education, eg anything less than degree level, the CSA will no longer get involved.

CM would only be continued if its part of the Consent Order but not sure what happens if parent fails to pay because csa wouldnt get involved.
