hi all thanks already for any replies you have all been great , im due in court tomorow again to review my exsisting order to see my son who lives with his mother , i get to see him every 2 weeks for 4 hours which has gone well, apart from my wife not wanting me to see him at all i have been to court lots to get to see him , so im on court tomorow to face her i have the caff cass report saying she thinks i should be alowed to see him for 8 hours to start with then another review for over night , which is good .my ex wants to contest this saying contact hasnt gone well etc etc etc yawn , my quesetion is will she be represented by freif like always as i have self rept for over a year and would like there to be an opportunity without being screwed by her solicitor as i do get upset and bewidered by big words ? or is it just me and old saddo ? what is the expectations of the visit ot court ? mwith breif without breif will caff cass speak to us both before and ask are we in agreement ? if shes not then see the magistrate if we do will she be allowed breif........thanks very much justice for nice fathers !!

Unfortunately the answer is yes, she will probably be represented if she has been thus far. Solicitors will try to take advantage of an LIP's inexperience and poor knowledge of the law, but at least you are aware of that and are expecting it.

On your side you have the CAFCASS report and the fact that you are acting in the best interest of your son. There's no reason why contact should be reduced, so the worst that can happen is that the court will keep things as they are. Some judges actually prefer LIPs because it cuts through all the BS. Just be yourself, tell the truth, and emphasise that it is in your son's best interest to have a normal relationship with his dad. Talk about what has gone well in the contact you have had and show that with more contact (overnight stays, etc) things will go even better. Don't let the solicitor wind you up, which is what he or she will try to do, don't make any allegations against your ex, don't refer to your rights, just focus on your son.

thanks i just thought it was before just me and ex , with caff cass first then if we cant agree it goes into the "room" before the judge without her breif but oh well ,we will fight all the way will let you know tomorow thanks again ..just a little light can grow plants

all went extremely well i now have my son for 8 hours contact every 2 weeks !! it went shakey but all good thanks for your support
