fact finding??? what does that mean?

just wondered if anyone does understand CAFCASS procedures? as I really have to get my head around. Been in violent relationship and had women's aid councelling-however still very confused and scared. Ex now turns everything around, says I was the violent person and an unfit mother. Wants full custody of our children. CAFCASS got involved, they told me on the phone that my ex had appointment with them and suggested "fact finding" from both of us followed by a court hearing. I have not had a Cafcass appointment so far and they told me that the court first has to make a decision. What does that mean? why didn't I get get a cafcass appointment?

sounds like your ex is winding you up only a court can approach a cafcass officer as they are court appointed. an order would need to made by the judge to order a cafcass appointment each of you would interviewed by the same cafcass at different times they then file their report based on their findings. a fact finding is when you cross examin each other in court to allow the judge to find the facts of the case and base their judgement on thier findings. keep your chin up and keep fighting the clean way

thank you knocker72. things start to make more sense.
bit complicated but after he unfortunately threatened to have me killed we had a court hearing because of the non-molestation order at which point he then came up with his allegations saying I was an unfit mother. court then decided to involve cafcass. he then had an appointment (according to cafcass) but I hadn't. and now they told me it would go to court for fact finding first. without having interviewed me???

sounds right as cafcass will write their report around the outcome of the fact finding held in court. they will arrange to meet you after this point to interview you before filing the report
